Terms and Conditions

These Terms and Conditions (“Terms”) apply to your use of the TaxPayCalculator website and calculator (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

TaxPayCalculator (“we”, “us”, “our”) provides an online tool that estimates Australian take-home pay, tax, Medicare, superannuation and related figures for informational purposes.

2. Acceptance of Terms

You must be at least 18 years old, or have a parent or guardian’s consent, to use the Service. By using the Service you confirm that you have read, understood and agree to these Terms and our Privacy Policy.

3. Nature of the Service — estimates only

The Service provides estimates only. Results are based on published Australian Taxation Office (ATO) rates, thresholds and simplified assumptions. They may not reflect:

  • your exact PAYG withholding on a payslip
  • every offset, rebate, deduction or levy that may apply to you
  • employer-specific arrangements, awards or salary packaging rules
  • state or territory payroll taxes, or future law changes not yet reflected in the tool

TaxPayCalculator is not a registered tax agent, BAS agent, financial adviser or lawyer. Nothing on the Service is tax, financial, accounting or legal advice. Do not rely on the Service as a substitute for advice from a qualified professional or official ATO information. Always confirm figures with your payroll provider, tax agent or the ATO before making decisions.

4. Australian Consumer Law

If you are a consumer under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL), you may have rights that cannot be excluded, including guarantees that services will be provided with due care and skill and are fit for an disclosed purpose.

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the ACL or other laws that cannot be excluded. Where we are allowed to limit our liability for a failure to comply with a consumer guarantee, our liability is limited (at our option) to supplying the services again or paying the cost of having the services supplied again.

5. Licence to use the Service

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes, in accordance with these Terms.

You must not:

  • copy, scrape, reverse engineer or republish the Service except as allowed by law
  • use the Service to provide paid tax or payroll advice to others without our written permission
  • interfere with the Service’s security, availability or integrity
  • use automated means to overload or abuse the Service
  • upload or transmit unlawful, harmful or infringing content
  • misrepresent the Service’s outputs as official ATO calculations or personalised professional advice

6. Your inputs and responsibility

You are responsible for the accuracy of salary and other figures you enter. Incorrect inputs will produce incorrect estimates. You remain solely responsible for your tax affairs, lodgements and compliance with Australian law.

7. Intellectual property

The Service, including its design, text, branding, software and layout, is owned by us or our licensors and protected by Australian and international intellectual property laws. You may not use our name, logo or content without prior written consent, except for fair dealing or other exceptions under the Copyright Act 1968 (Cth).

8. Third-party information and links

The Service may reference ATO rates, government publications or link to third-party websites. We do not control those resources and are not responsible for their content, availability or accuracy. Links do not imply endorsement.

9. Availability and changes

We aim to keep the Service available and up to date, but we do not guarantee uninterrupted access, error-free operation, or that rates and thresholds will always match the latest official sources immediately after a change. We may modify, suspend or discontinue any part of the Service at any time without notice.

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use after an update means you accept the revised Terms, to the extent permitted by law.

10. Disclaimer of warranties

To the maximum extent permitted by law (and subject to section 4), the Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law (and subject to section 4), we are not liable for any loss or damage arising from your use of, or reliance on, the Service, including:

  • loss of income, tax, refunds, penalties or interest
  • indirect, incidental, special or consequential loss
  • loss of data, business or opportunity
  • decisions made based on calculator estimates

Where liability cannot be excluded, our total aggregate liability arising out of or in connection with the Service or these Terms is limited to AUD $100, or the amount you paid us (if any) in the 12 months before the claim, whichever is greater.

12. Indemnity

You agree to indemnify us against reasonable claims, losses and costs (including legal costs on a solicitor–client basis) arising from your misuse of the Service, your breach of these Terms, or your reliance on estimates without professional advice — except to the extent caused by our negligence or wrongdoing, or where the ACL prevents such an indemnity.

13. Privacy

How we handle personal information is described in our Privacy Policy. By using the Service you acknowledge that policy.

14. Acceptable use

You must use the Service only for lawful purposes and in a way that does not infringe others’ rights or restrict their use of the Service. We may suspend or block access if we reasonably believe you have breached these Terms.

15. Termination

You may stop using the Service at any time. We may suspend or end your access immediately if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive (including intellectual property, disclaimers, liability and indemnity) continue after termination.

16. Governing law and disputes

These Terms are governed by the laws of Australia and, where applicable, the state or territory in which we operate. You submit to the exclusive jurisdiction of the Australian courts, without limiting any mandatory consumer rights you have in your place of residence.

If a dispute arises, please contact us first so we can try to resolve it. You may also have rights to complain to bodies such as the Australian Competition and Consumer Commission (ACCC) or your state or territory consumer affairs agency.

17. General

  • If any part of these Terms is invalid or unenforceable, the rest remains in effect.
  • Our failure to enforce a right is not a waiver of that right.
  • These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
  • You may not assign your rights under these Terms without our consent. We may assign our rights as part of a restructure or sale.
